Prosecution: Defense can’t argue self-defense in fatal 2016 stabbing

CLARKSBURG — The state contends a man charged with murder in a fatal Clarksburg stabbing shouldn’t be permitted to argue self-defense.

When John Thomas III used deadly force against victim Roy Horton, Thomas didn’t believe Horton “was about to inflict death or serious bodily harm on him,” Assistant Prosecutor Andrea Roberts asserts.

She cites statements by the 57-year-old Thomas as well as a police interview of him.

Thomas is set for trial the week of June 5 on a murder charge, with Judge Chris McCarthy presiding. The sides will argue pretrial issues at a pretrial hearing next Friday.

In the interview recorded by police, Thomas said Horton “grabbed him by the back of the neck, and then (Thomas) states ‘I turned around and jilted him with it. I said, ‘man, you don’t live here,'” according to Roberts.

According to Thomas, Horton then said, “You stuck me,” Roberts asserts.

Peoria man takes plea deal; sentenced to 20 years for botched fatal robbery

PEORIA — A Peoria man was sentenced Friday to 20 years in prison for his part in a 2012 murder that resulted from a botched robbery.

Robert C. Nunn, Jr. now 23, pleaded guilty in Peoria County Circuit Court to second-degree murder as part of a deal that saw a first-degree murder charge dropped, said his attorney William Loeffel.

The plea came after an appellate court panel last summer threw out Nunn’s conviction for the murder of Kelin “Noopy” Drummond in May 2012. Nunn had originally received a life sentence. But the appellate judges found a judge here improperly barred a Facebook conversation at the December 2012 trial. The case was sent back to Peoria County last summer.

The community is in mourning following the fatal shooting on Interstate Highway 80 in Richmond last week that claimed the life of 24-year-old Demarcus Doss.

Prosecutor: Teen’s fatal shooting in Penbrook may have been in self-defense

PENBROOK, Pa. (WHTM) – A Dauphin County prosecutor says a 16-year-old boy may have been may have been shot in self-defense after he broke into a Penbrook home last week.

First Assistant District Attorney Fran Chardo said authorities continue to investigate whether Thursday’s incident in the 2500 block of Walnut Street was a justified use of force.

Authorities said the teen entered the house with a 19-year-old and someone who lived there fatally shot him. Authorities have not released the teen’s name.

The 19-year-old, Davaughn Jackson, was arrested for robbery, burglary and other charges related to the incident. He is in Dauphin County Prison on $100,000 cash bail.

Authorities said the pair broke into the house to steal video games, a gaming console, and money.
